Terms & Conditions

These Terms & Conditions constitute a binding agreement between Chandrabhan Singh Dhakad (operating as Asha Web Tech, "Service Provider") and any individual or organisation ("Client") engaging our freelance web development and digital services. Engaging our services implies full acceptance of these terms.

1 Scope of Services

We provide the following services as agreed upon in the project proposal or work order:

  • Website and web application development (React, Next.js, Vue, Node.js, PHP)
  • E-Commerce development (Shopify, WooCommerce, Magento)
  • Mobile application development (Flutter, React Native)
  • SaaS platforms, ERP/CRM systems, and custom business tools
  • API development, REST/GraphQL, and third-party integrations
  • SEO and Digital Marketing campaigns

The specific deliverables, timelines, and payment milestones shall be outlined in a separate project proposal or agreement shared prior to project commencement.

2 Project Commencement

Work on a project begins only after:

  • The project scope, deliverables, and timeline have been mutually agreed upon in writing (email/WhatsApp/formal agreement)
  • The advance payment (as specified in the proposal) has been received
  • The client has provided all required assets, credentials, and information needed to begin work

3 Payment Terms

All payments are structured on a milestone basis:

  • Advance (typically 30–50%): Due before project commencement
  • Mid-project milestone(s): Due upon completion of agreed stages (if applicable)
  • Final payment: Due upon project completion and before final delivery/deployment

Accepted payment methods include bank transfer, UPI, Razorpay, Stripe, PayPal, and other methods mutually agreed upon. All prices are in Indian Rupees (INR) unless otherwise specified. International clients may be invoiced in USD.

Note: Delays in payment may result in project delays. Work may be paused if payment is not received within 7 days of a milestone being reached.

4 Client Responsibilities

The client agrees to:

  • Provide accurate, complete, and timely information, assets (logos, images, content), and access credentials required for the project
  • Review and provide feedback or approval within agreed timelines (typically 3–5 business days per milestone)
  • Communicate changes in requirements promptly
  • Not request changes that fundamentally alter the agreed scope without a revised project agreement

Delays caused by the client's failure to meet these responsibilities may extend the project timeline without any penalty on the Service Provider.

5 Revisions & Change Requests

Each project includes a defined number of revision rounds as stated in the proposal (typically 2–3 rounds of minor revisions per milestone). Revisions are limited to corrections and refinements within the agreed scope.

Additional revisions, scope additions, or feature changes beyond the agreed scope will be quoted separately and charged accordingly.

6 Intellectual Property & Ownership

Upon receipt of full and final payment:

  • All custom code, designs, and deliverables created specifically for the client's project transfer to the client's ownership
  • Generic libraries, frameworks, and third-party components used in the project remain subject to their respective open-source or commercial licences
  • We retain the right to showcase the completed project in our portfolio unless the client requests confidentiality in writing

Prior to full payment, all work remains the intellectual property of Chandrabhan Singh Dhakad.

7 Confidentiality

We treat all client information, business data, credentials, and project details as strictly confidential. We will not disclose any client-specific information to third parties without prior written consent, except as required by law.

8 Project Delivery & Deployment

Project delivery timelines are estimates provided in good faith. Factors such as client response delays, scope changes, or unforeseen technical challenges may affect timelines. We will communicate any delays proactively.

Final deployment to the client's live server requires the client to provide hosting access. We are not responsible for hosting-related issues, domain configurations, or third-party service outages post-deployment.

9 Post-Delivery Support

We provide a bug-fix warranty period of 15 days from the date of final delivery for issues directly arising from our development work. This does not cover:

  • New feature requests or scope additions
  • Issues caused by client modifications to the code
  • Third-party service failures or API changes
  • Hosting, server, or domain issues

Ongoing maintenance, support retainers, or extended SLA agreements are available as separate paid engagements.

10 Limitation of Liability

Our total liability to the client in connection with any project shall not exceed the total amount paid by the client for that specific project. We shall not be liable for any indirect, consequential, or special damages including loss of business, data loss, or lost profits arising from the use of the delivered work.

11 Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of India. Any disputes arising from these terms or project engagements shall first be attempted to be resolved through mutual negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Bhopal, Madhya Pradesh, India.
